1. Acceptance of Terms

By using the ShiftLinked platform, calling our business phone line, or receiving SMS communications from Fire Safety Tactics LLC, you agree to these Terms and Conditions. If you do not agree, please discontinue use of our services.

2. About ShiftLinked

ShiftLinked is a staffing platform operated by Fire Safety Tactics LLC that connects companies needing security, fire guard, and fire life safety professionals with qualified workers in New York City.

3. SMS Messaging Program

Fire Safety Tactics LLC operates an SMS messaging program through the ShiftLinked platform. By registering on the Platform and providing your mobile phone number with consent, or by texting an opt-in keyword, you agree to the following terms:

• Program Name: ShiftLinked Notifications by Fire Safety Tactics LLC
• Program Description: Fire Safety Tactics LLC sends shift availability notifications, onboarding reminders, and platform links to security and fire life safety professionals registered on the ShiftLinked staffing platform. Messages are sent only to users who have opted in.
• Opt-In Methods: You opt in by (a) registering on the ShiftLinked platform at https://shiftlinked.com/WorkerLanding, providing your mobile phone number, and consenting to receive SMS messages; or (b) texting START or JOIN to +1 (646) 222-3536.
• Opt-In Keywords: START, JOIN
• Opt-In Message: "Fire Safety Tactics LLC: You're now opted in to ShiftLinked shift notifications and updates. For help, reply HELP. To opt out, reply STOP. Msg & data rates may apply."
• Message Frequency: Recurring. Message frequency varies based on shift availability and account activity.
• Opt-Out Keywords: STOP, STOPALL, CANCEL, END, QUIT, UNSUBSCRIBE, REVOKE, OPTOUT
• Opt-Out Message: "You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe."
• Help Keywords: HELP, INFO
• Help Message: "Reply STOP to unsubscribe. Msg&Data Rates May Apply."
• Cost: Message and data rates may apply depending on your carrier plan.
• Carriers: Messages are delivered through Twilio and participating wireless carriers. Not all carriers are supported.
• Age Requirement: You must be 18 years or older to participate in the SMS program.
• No Sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support of SMS delivery (such as Twilio) is permitted solely to operate the messaging program.
• Liability: Fire Safety Tactics LLC, its messaging providers, and participating carriers are not liable for delayed or undelivered messages. We do not guarantee message delivery.
• Voluntary: Participation in the SMS program is voluntary and is not required to use the Platform.

4. Platform Use

Users of the ShiftLinked platform agree to:

• Provide accurate and truthful information during registration and profile setup
• Use the platform only for lawful purposes
• Refrain from misrepresenting qualifications, certifications, or experience
• Comply with all applicable labor laws and regulations
• Not engage in harassment, fraud, or misconduct toward other users

5. Worker Responsibilities

Workers using ShiftLinked agree to fulfill accepted shifts as scheduled, notify the platform and employer of any cancellations within the required notice period, maintain professional conduct and appearance standards, and hold all required licenses and certifications for posted roles.

6. Employer Responsibilities

Employers using ShiftLinked agree to provide accurate shift descriptions and working conditions, pay the agreed hourly rate through the platform, treat workers with respect and in compliance with applicable employment laws, and provide a safe working environment.

7. Payments and Fees

All payments are processed through the ShiftLinked platform. A platform service fee applies to each shift. Workers receive their agreed-upon rate minus applicable platform fees. Fire Safety Tactics LLC reserves the right to modify fee structures with advance notice.

8. Limitation of Liability

Fire Safety Tactics LLC is not liable for disputes between workers and employers, losses arising from shift cancellations, or any indirect, incidental, or consequential damages arising from use of the platform. The platform serves as a marketplace and is not the employer of record for workers placed through ShiftLinked.

9. Termination

We reserve the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or misuses the platform. Users may also close their accounts at any time by contacting support.

10. Governing Law

These Terms are governed by the laws of the State of New York. Any disputes arising from use of the platform shall be resolved in the courts of New York County, New York.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
